The purchase of this template is for one 17hats brand only, and should not be shared electronically, verbally, and/or by any other method with any other 17hats brands, software, business, or people.  Deb Mitzel Creative retains the copyright of the items purchased.   By purchasing this template, the buyer acknowledges the item is furnished as is, without warranty of any kind, and agrees that the seller shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, whether arising out of the use or inability to use the template.  The seller disclaims a responsibility for any errors, defects, or interruptions in the functionality of the template.  The buyer accepts full responsibility for the selection and use of the template and releases the seller from any liability for damages, regardless of the cause or nature of such damages. 

SERVICE SPECIFIC TERMS & CONDITIONS

1. Scheduling and Completion All services purchased must be scheduled and fully completed within sixty (60) days of the date of purchase.
2. Payment and Refunds Fees for all services are due in full at the time of booking. All payments are final and non-refundable.
3. Transfer of Services A purchased service may be transferred to another individual, provided written notice is received by Deb Mitzel Creative within thirty (30) days of the original purchase date.  In the event of a transfer, services must still be scheduled and fully completed with sixty (60) days of the date of purchase.
4. Cancellation & Rescheduling
   1. Notice Required You may cancel or reschedule a booked service appointment by providing at least 48 hours’ written notice to Deb Mitzel Creative.
   2. Rescheduling You may reschedule once at no additional charge; any further reschedule requests must be made at least 48 hours in advance and are subject to our availability.
   3. Late Cancellations & No-Shows If you cancel or request to reschedule with less than 48 hours’ notice, or fail to attend your appointment (“no-show”), the session will be deemed rendered and no refund or transfer will be permitted.
   4. How to Notify To cancel or reschedule, please email [email protected] with your name, the original appointment date, and your requested new date/time.
5. Confidentiality Deb Mitzel Creative will maintain in confidence any information you share during the provision of services. Proprietary or sensitive client information will not be disclosed to any third party without your express consent, except as required by law.
6. Limitation of Liability In no event shall Deb Mitzel Creative be liable to you or any third party for any loss of use, revenue, profit, or for any consequential, incidental, indirect, exemplary, special, or punitive damages—whether in contract, tort (including negligence), or otherwise—even if advised of the possibility of such damages.
7. Dispute Resolution Any dispute arising out of or relating to these terms shall be resolved exclusively by binding arbitration in Brainerd, Minnesota, under the American Arbitration Association’s rules. The arbitrator’s decision will be final and binding. Costs of the arbitration (including reasonable attorneys’ and experts’ fees) will be borne by the party determined to be liable; if liability is shared, costs will be apportioned accordingly. Both parties agree to continue performing obligations under these terms pending resolution.
8. Force Majeure Deb Mitzel Creative shall not be liable for delays or failures in performance caused by events beyond its reasonable control, including but not limited to acts of God, fire, flood, war, terrorism, strikes, governmental actions, or utility outages. If such an event continues for more than fifteen (15) consecutive days, you may elect to terminate the affected service, and any unrendered portion may be rescheduled at no additional charge.
9. Time Is of the Essence
   1. Client Responsibilities You agree to provide all information, materials, and approvals (“Client Materials”) necessary for the delivery of your purchased services according to any mutually agreed-upon deadlines.
   2. Timely Delivery Time is of the essence. If Client Materials are not delivered by the specified deadlines, Deb Mitzel Creative may, at her discretion:
      1. Adjust the delivery schedule of your service to accommodate the delay;
      2. Require rescheduling of your appointment or milestone delivery; or
      3. Treat the service as completed and apply applicable cancellation/no-show provisions if no new dates can be mutually agreed upon.
   3. Impact on Service Window Since all services must be completed within sixty (60) days of booking, any delay in providing Client Materials may reduce the available window for scheduling and completion. If the remaining window is insufficient, your service may be deemed to have been rendered—and no refund or transfer will apply—unless otherwise agreed in writing.

INTELLECTUAL PROPERTY NOTICE

All images, text, designs, graphics, trademarks, and service marks are owned by and property of Company, or the properly attributed party. It is a violation of federal law to use any of Our intellectual property in whole or in part, and modification of any materials contained on this site is illegal and may be prosecuted to the fullest extent permissible should We choose to do so, including asking for financial penalties (damages) and/or an injunction forcing You to stop using Our intellectual property immediately.

You may NOT use Our intellectual property in any way, which includes republishing any text, image, design, or other property on another website, or posting a quote or image from Our site to any third-party website including social media. We have spent a great deal of time and money building the intellectual property located on this site and in order to maintain the integrity of it, We cannot allow any third party use.

You agree to pay any applicable shipping and/or handling fees as stated on your checkout cart screen.

ERRORS OR MISTAKES IN PRICING

We reserve the right to correct any errors or mistakes in pricing, even if We have already received payment. Any such changes will be conveyed in writing via email to notify You of Our correction and to allow You to take the most appropriate action in the event of such a correction or mistake.

REFUNDS AND RETURN POLICY

Due to the nature of the services and/or products provided, refunds will not be given unless otherwise specified in writing.

PROMOTIONAL PRICING DEVICES AND PRICE ADJUSTMENTS

We are not able to accommodate a price adjustment after Your purchase.

CHARGEBACKS

​​You agree to make every attempt to file a refund prior to attempting a chargeback with Your financial institution. In the event of a chargeback attempt, You expressly agree to forfeit any and all of Our bonuses, affiliate bonuses, or other materials afforded to You in exchange for Your original purchase of Our Offering. We reserve the right to present proof of Your access and these Terms and Conditions of Use to the financial institution investigating the dispute.

REVOCATION​ ​OF​ ​ACCESS

Upon confirmation of Your termination, any and all outstanding balances will become immediately due and payable. Any existing balance that remains after 14 days from the date of termination will be sent to a collections agency, and You agree to be responsible for any additional charges, fees, or costs associated with such a collection effort, including but not limited to reasonable attorney’s fees and court costs.

CURRENCY

All payments will be processed in the local currency, or if not specified at checkout, in US Dollars.

TAXES

Sales taxes will be applied to your order as required by law in either Your or Our local area(s).

ORDER REVERSAL OR CANCELLATION

We reserve the right to refuse to fulfill any order placed on Our website, in part or in full, and will issue a refund accordingly. We reserve the right to limit or cancel quantities purchased by any given user or household at our sole discretion.
